RE: BREACH OF CONSTITUTIONAL DUTY: STRUCTURAL EXCLUSION OF
MAIYOO KEYOH GOVERNANCE IN THE PATHWAY FORWARD 3.0
AGREEMENT

On behalf of the Maiyoo Keyoh Society and the lawful Indigenous government
of the Maiyoo Keyoh, we write to address the serious constitutional and
governance failures embedded in the Pathway Forward 3.0 Agreement. This
open letter is shared publicly to uphold transparency, ensure accountability,
and invite responsible cross-party engagement on matters of Indigenous title,
governance, and reconciliation.
The Maiyoo Keyoh exercises an inherent governance system under Dakelh law,
with an unbroken lineage of authority that predates the Indian Act and
continues today. Our purpose is to ensure that any agreement affecting our
ancestral territory is constitutionally valid, respects our inherent governance,
and is developed only through lawful and meaningful consultation with the
Maiyoo Keyoh.
Yet the Pathway Forward 3.0 Agreement is a constitutional failure. By excluding
lawful Indigenous governments and entrenching Indian Act structures, it
perpetuates the very colonial harm reconciliation is meant to redress. Proper
recognition and engagement are required; anything less constitutes a breach of
the honour of the Crown and the constitutional protections affirmed by Section 35.
